1. Acceptance of Terms
Welcome to ServerMania("us", "we", "our", or the "Company"). By accessing or using our websites, applications, hosting environments, and servers, you agree to be legally bound by these Terms & Conditions (the "Terms").
If you do not agree with any part of these Terms, you must immediately cease all access and use of our products, systems, and services.
2.Account Registration & Security
To provision dedicated servers, cloud platforms, or alternative services, you are required to register for an authorized user account. You explicitly agree to:
- Provide accurate, current, and complete identification and billing information.
- Maintain the baseline security of your account passwords, credentials, and API access tokens.
- Promptly notify our support infrastructure regarding any discovered security breach or unauthorized usage.
ServerMania cannot and will not be liable for any data loss, damages, or service interruptions arising from your failure to protect your login credentials.
3. Acceptable Use Policy (AUP)
Our network infrastructure must be utilized strictly for lawful operational frameworks. You explicitly agree that your allocated server instances will not engage in:
Malicious Actions
Distributing viruses, malware, trojan horses, or launching distributed denial-of-service (DDoS) operations against external infrastructures.
Abusive Activity
Sending unsolicited bulk commercial communications (SPAM), conducting automated network scraping without authorization, or storing cryptographic mining operations unless specifically outlined by contract contracts.
IP Infringement
Hosting or transferring media, documents, or proprietary software configurations that directly infringe upon any corporate patent, trademark, or active copyright standard.
4.Billing, Fees & Cancellation
All hosting service plans operate on a recurring subscription model. Payments are collected prior to service provisioning based on your chosen billing frequency (monthly, quarterly, or annually).
- Late Payments: If processing parameters fail, we reserve the right to suspend operations after notification intervals expire.
- Cancellation Requests: Service terminations must be officially submitted through your customer service portal before the subsequent automatic billing cycle occurs.
5.Service Level Agreement (SLA) & Backups
While ServerMania strives for peak hardware stability, network connectivity, and uptime metrics as outlined in our supplemental SLA configurations, you are fundamentally responsible for your data.
6. Limitation of Liability
To the maximum extent permitted by applicable jurisdiction, ServerMania shall not be held liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data architectures, system down-time, or business opportunities arising directly out of the usage or programmatic execution of our services.
7.Severability & Jurisdiction
Should any provision of these Terms be deemed unenforceable or unlawful by a competent court of law, that individual element will be adjusted to accurately reflect its core intent, while all remaining segments retain full legal effect and implementation.
8. Modification of Terms
We reserve the right to modify these Terms & Conditions at any time. Changes become active immediately upon being published to our public network endpoints. Your continued engagement with our hosting infrastructure indicates direct agreement with all revised operating terms.
